Can a night club deny employment to an applicant because he or she is married?

I applied as a bartender at Electric Cowboy, a night club with franchises throughout the USA. I was asked in the interview if I am married. The interviewer stated the reason he wanted to know is because there is a corporate policy against allowing a spouse of an employee into the night club as it could cause problems. It seems to me that this interview question could and should have taken on the form of a declarative statement, rather than a potentially discriminatory question. Is it a legal question?

Legal. It is asked for as part of their statement of policy. They aren’t not hiring someone they are just warning them that their spouse isn’t going to be allowed in when they work.
